There’s part of me who is sneakily proud that there’s unofficial Sutton merchandise as it means we’re big time.
That however will haunt my nightmares

They're an abomination.
I'm sure everyone really likes an utterly garish design which breaks copyright on a "baseball jersey"
Done by people who have no clue about English football to make a quick buck (and I use the word buck on purpose) out of those too stupid enough to know better.

Aesthetic considerations aside, although I am not an intellectual property lawyer, I'm pretty sure that the badges and crests of English football clubs are the artistic works of the individual clubs and are therefore entitled to copyright protection within the meaning of section 3(1) of the Copyright Designs and Patent Act 1988 as confirmed by the Court of Appeal in Football Association Premier League Ltd and others v Panini UK Ltd [2003] EWCA Civ 995... www.bailii.org/ew/cases/EWCA/Civ/2003/995.htmlI am not sure this forum should be used to link to material which is arguably unlawful.

I just wonder how they get away with it. As Trev says surely there's copyright involved. If you accept the merchandise infringes Sutton United's copyright then why link to it?

If that's your genuine concern then you should have raised it directly with the club rather than circulate illicit material on the forum.

Fair point, Trev, but you could also argue that by raising the matter here then some of the Sutton United community are "educated" that the merchandise is "hookie gear" and will, more likely than not, spend their money on the genuine articles bought through the club shop. Personally, got a lot of confidence that the average U's supporter would be happy to spend a bit more on getting high quality genuine merchandise and in knowing that the profits go to supporting the club they love.

The seller is based in Delaware. This is the US state of rogue companies (and a well known glove puppet) where it is possible to hide the names of the owners / directors from public records. If you are going to flout copyrights, that protection enables you to close the company and start a new one without incurring a record.
